Terms of Service

These Terms of Service (“Terms”) govern your access to and use of uploadthefile.com and its related websites, subdomains, and services (collectively, the “Service”). The Service is operated by Smile Mask Technology FZE, a free-zone establishment registered in the Dubai World Trade Centre (DWTC) Free Zone, Dubai, United Arab Emirates (“we,” “us”). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

uploadthefile.com lets you upload files and turn them into shareable links, and host certain content (such as web pages) on public addresses including *.upload.tf subdomains and short links. Features, limits, and availability may change over time.

2. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. The Service is not directed to children, and we do not knowingly permit children under 13 to create an account without verified parental or guardian consent. You may create an account with an email and password, a one-time sign-in link, or a third-party sign-in provider (such as Google, GitHub, or Microsoft).

If you use the Service on behalf of a company, organization, or other legal entity, you confirm that you are authorized to accept these Terms for that entity, and “you” refers to it. You agree to provide accurate and complete account information, to keep it up to date, and you confirm that you are not barred from using the Service under any law or sanctions program that applies to you.

You are responsible for your account and for keeping your credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at contact@uploadthefile.com if you suspect unauthorized use. We may suspend or close accounts that remain inactive for an extended period, for example, with no sign-in or activity for twelve months, after making a reasonable attempt to reach you where we hold a valid contact address.

3. Plans, billing & refunds

The Service offers a free tier and paid plans. Paid subscriptions are billed in advance on a recurring basis through our payment processor. Prices and plan features are described on our pricing page and may change with notice for future billing periods.

You can cancel at any time; cancellation takes effect at the end of the current billing period and does not retroactively refund amounts already paid, except as required by law or as stated in our refund policy. For billing questions, contact contact@uploadthefile.com.

4. Acceptable use

You agree not to use the Service to upload, host, link to, or distribute content that:

• is illegal, or facilitates illegal activity;
• contains malware, viruses, or other harmful code;
• is used for phishing, fraud, or impersonation;
• infringes the intellectual property or privacy rights of others;
• is sexually exploitative of minors (we report such material to the authorities);
• is pornographic or obscene, or otherwise violates public decency or morality;
• promotes or facilitates gambling;
• is defamatory, or insults or denigrates religions or beliefs, or any nation, government, or its symbols;
• is designed to bypass access controls, network restrictions, or censorship (for example, circumvention or anonymizer tools, proxy or VPN configurations distributed for that purpose);
• harasses, threatens, or incites violence against others; or
• sends spam or otherwise abuses the Service or its infrastructure.

You also agree not to attempt to disrupt, reverse engineer, or gain unauthorized access to the Service, or to circumvent usage limits or security measures, and not to resell, sublicense, or commercially redistribute the Service or access to it without our written consent. You are responsible for complying with the laws that apply to you, including export-control and sanctions laws, and you may not use the Service where doing so would be unlawful. Some prohibited categories reflect requirements of the laws of the United Arab Emirates, where we are established, and apply regardless of where you are located.

5. Your content

You retain ownership of the files and content you upload (“Your Content”). You grant us a worldwide, non-exclusive license to host, store, reproduce, and serve Your Content solely as needed to operate and provide the Service (for example, delivering it to visitors of the links you create). Content you choose to publish is publicly accessible to anyone with the link.

When you upload or configure Your Content, you instruct us to host, store, process, and serve it. That instruction — together with your sharing settings, feature configuration, and any API calls you make — is your documented instruction for how we handle Your Content.

To the extent Your Content contains personal data and data-protection law applies to you as a controller (or you act for one), we process that personal data as your processor, only on your instructions, under our Data Processing Terms, which are incorporated into these Terms.

You represent that you have the rights necessary to upload and share Your Content and that doing so does not violate these Terms or any law. You further represent that you have the right and, where applicable, the lawful basis and authority to upload the content and to instruct its processing, including for any third-party personal data it contains. This representation applies even when you upload without an account.

You are responsible for keeping your own copies of Your Content. The Service is not a backup service, and you should not rely on it as your only copy. When you delete Your Content or close your account, we stop serving it promptly, but residual copies may persist for a limited time in backups, caches, or logs before being overwritten in the ordinary course, and we may retain material we are legally required to keep.

6. Reporting, moderation & removal

We operate a notice-and-takedown process. Anyone can report content that is illegal, infringing, or otherwise violates these Terms, including a copyright/DMCA-style notice, by emailing contact@uploadthefile.com with enough detail to locate the material and substantiate the claim. We review reports and remove or disable content that breaches these Terms or the law, and in appropriate cases we terminate the accounts of users who repeatedly infringe the rights of others.

We may scan, review, restrict, or remove content and may suspend or terminate accounts that violate these Terms or pose a risk to the Service or others, with or without notice where appropriate, using automated and manual safety checks (including reputation and malware scanning). We comply with valid legal and regulatory orders, including content-removal or access-blocking orders from competent authorities, and may preserve and disclose information where we are legally required to do so or where necessary to report unlawful material (including child sexual abuse material) to the appropriate authorities.

This safety, security, and legal-compliance scanning, moderation, and abuse handling is processing we carry out for our own purposes as an independent controller — as described in our Privacy Policy and Data Processing Terms — not on your instructions.

7. Availability, changes & beta features

We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, or free of errors. The Service may be unavailable during planned maintenance, or because of events outside our reasonable control. We may add, change, suspend, or withdraw features at any time.

We sometimes offer features labeled beta, preview, early access, or experimental. These are provided “as is,” may be changed or removed at any time, may be less reliable than generally available features, and are not intended for production-critical use. Any additional terms we present for a specific beta feature apply to your use of that feature.

8. Our intellectual property

The Service itself, including its software, design, and trademarks, is owned by us or our licensors and is protected by law. These Terms do not grant you any right to our branding except as needed to use the Service normally.

9. Feedback

If you send us feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, without obligation or payment to you. Feedback is not confidential, and we may already be developing similar ideas independently.

10. Third-party services & links

The Service relies on third parties (for example, cloud hosting and authentication, payment processing, and AI features). Your use of those features may also be subject to the third party’s terms. We are not responsible for third-party services we do not control.

The Service may also contain, or let users publish, links to websites and resources we do not operate. We do not endorse and are not responsible for their content, products, or policies, and accessing them is at your own risk.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that content will not be lost.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $100.

To the extent permitted by law, any claim relating to the Service must be brought within one year after the event giving rise to it; after that, it is permanently barred.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content or your misuse of the Service or violation of these Terms.

14. Termination & discontinuation

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or where required by law. We may also stop offering the Service, or any part of it. Where we discontinue a paid feature you are actively using, we will try to give reasonable advance notice and, where practical, a window to export Your Content before it becomes unavailable.

Provisions that by their nature should survive termination (such as ownership, the feedback license, disclaimers, limitation of liability, indemnification, and the general terms below) will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance.

16. Governing law & disputes

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws rules, and the courts of Dubai have jurisdiction. Nothing in these Terms removes any mandatory consumer-protection or other rights you have under the laws of your country of residence that cannot be waived by agreement. If any provision is found unenforceable, the remaining provisions remain in effect.

17. General

We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets; you may not assign them without our prior written consent. These Terms do not create any rights for anyone other than you and us. They are the entire agreement between you and us about the Service and replace any earlier agreements on that subject, together with any policies referenced in them (such as our Privacy Policy, Data Processing Terms, and refund policy). Our not enforcing a provision is not a waiver of our right to enforce it later. We are not liable for any delay or failure to perform caused by events beyond our reasonable control. Section headings are for convenience only and do not affect interpretation.
